1. Who we are
These Terms govern access to and use of AdMonitorHQ (the "Application") and this website, provided by Jimm Barrow, doing business as AdMonitorHQ ("we", "us"). They apply to the members of our team who use the Application and to the team members who connect the advertising accounts they hold. By using the Application, or by authorizing it for an advertising account, you agree to these Terms.
2. What the Application is
The Application is an advertising operations console. It lets authorized members of our team review the campaign structure, monitor spend and performance, and pause, resume or delete campaigns, ad groups and ads in the advertising accounts through which we run our own advertising. Deletion is carried out through the platform API and is irreversible. It connects to those accounts through the TikTok Marketing API. It is not offered to the general public and is not sold, sublicensed or resold.
3. Access and connected accounts
If you use the console as a member of our team:
- Access is granted to named team members only, and may be withdrawn at any time.
- You are responsible for keeping your credentials confidential and for all activity carried out under your account.
- You may work only in advertising accounts we have been authorized to operate.
If you hold an advertising account connected to the console:
- You connect the account yourself, by granting the authorization in TikTok Ads Manager, and you may withdraw it there at any time.
- You confirm that you are entitled to grant that authorization for the account concerned.
- Withdrawing the authorization ends our access immediately and starts the deletion described on the Data Deletion page.
4. Acceptable use
When using the Application you must not:
- use it to access, scrape or manipulate accounts we have not been authorized to operate;
- run advertising that is unlawful, deceptive, infringing, or that violates the advertising policies of the platform it runs on;
- attempt to artificially inflate metrics, generate fake engagement, or otherwise circumvent platform integrity systems;
- reverse engineer, resell or redistribute the Application or the data it retrieves;
- interfere with the security or availability of the Application or of any connected platform.
5. Third-party platforms
The Application connects to third-party platforms through their public APIs. Your use of those platforms remains governed by their own terms and policies, and we are not responsible for their availability, decisions or changes. A platform may restrict, suspend or revoke API access at any time, which may limit or disable parts of the Application. We are not affiliated with, endorsed by or sponsored by any platform, and all third-party trademarks belong to their respective owners.
6. Data and privacy
Our handling of data, including data obtained through platform APIs, is described in the Privacy Policy, which forms part of these Terms. Deletion requests are handled as described on the Data Deletion page.
7. Intellectual property
The Application, this website and their contents are our property or licensed to us, and are protected by intellectual property law. These Terms grant no license other than the limited right to use the Application as described above. Advertising creatives and campaign content remain the property of their owner.
8. Availability
The Application is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted operation, and we may modify, suspend or discontinue any part of it, including in response to changes in a platform's API.
9. Disclaimer and liability
To the fullest extent permitted by law, we exclude all implied warranties, and we are not liable for indirect, incidental or consequential damages, loss of profit, loss of data or loss of reach arising from the use of, or inability to use, the Application. Nothing in these Terms excludes liability that cannot be excluded by law.
10. Indemnity
You agree to indemnify us against claims arising from your misuse of the Application or your breach of these Terms or of a connected platform's rules.
11. Suspension and termination
We may suspend or terminate access immediately if these Terms or a platform's policies are breached. On termination, the rights granted here end, and stored data is deleted in line with the retention periods in the Privacy Policy.
12. Changes to these Terms
We may update these Terms. The date at the top of this page shows when they last changed. Continued use after an update means acceptance of the revised Terms.
13. Governing law
These Terms are governed by the laws of the State of Wisconsin and the federal laws of the United States, without regard to conflict-of-law principles. The state and federal courts located in Milwaukee County, Wisconsin have exclusive jurisdiction over any dispute arising out of these Terms, and you consent to personal jurisdiction and venue there.
